Automated Decision-Making (EU/UK Users)

If you are located in the European Union or United Kingdom, you have the right not to be subject to a decision based solely on automated processing that produces legal or similarly significant effects concerning you, under GDPR Article 22 and the UK GDPR. During declared public health emergencies, the information provided on this platform may be rapidly evolving and may not reflect the most current guidance from public health authorities. In any health emergency, users should follow guidance from national and local public health authorities (including WHO, CDC, ECDC, NHS, and equivalent bodies in your jurisdiction) and should not rely on this platform as a primary source of emergency health guidance.

Vulnerable Populations

This platform is not designed to provide advice to individuals with serious or complex medical conditions, compromised immune systems, or those under active medical supervision. If you are in any of these categories, you are strongly advised to consult your healthcare provider before acting on any information obtained from this platform. This platform is not a substitute for emergency medical services; if you are experiencing a medical emergency, contact your local emergency services immediately.

All content, trademarks, data visualizations, code, and logos on Virus Watcher are the property of Virus Watcher or its licensors. You may not use, copy, reproduce, distribute, transmit, broadcast, display, sell, license, or otherwise exploit any content without prior written permission.

AI-generated outputs delivered to you through this platform are licensed to you for personal, non-commercial informational use only. No copyright or other intellectual property rights are transferred to you in AI-generated outputs. You may not redistribute, resell, or commercially exploit AI-generated outputs without our prior written consent. The legal status of copyright in purely AI-generated content varies by jurisdiction, and Virus Watcher makes no representation regarding the copyrightability of AI outputs.

Our platform may contain links to third-party websites or services. We are not responsible for the content or practices of any linked websites or third-party services. Your use of such websites and services is subject to their respective terms and conditions.

Where outbreak or health data is sourced from third parties (including but not limited to WHO, CDC, ECDC, ProMED, or other epidemiological databases), such data is subject to the licensing and attribution terms of those sources.

Your use of Virus Watcher is also governed by our Privacy Policy, which describes how we collect, use, and share your information.

Health-related data (including symptom inputs, watchlist preferences, and location data used in outbreak monitoring) may constitute special category data or sensitive personal information under applicable law, including GDPR Article 9 (EU/UK), CCPA/CPRA (California), and equivalent regimes. Such data is processed only with your explicit consent or on another lawful basis described in our Privacy Policy. You have the right to access, rectify, erase, and port your personal data, and to object to or restrict its processing, as set out in our Privacy Policy and applicable law.

When fully launched, Virus Watcher may offer premium features through subscription services. Additional terms regarding billing, cancellation, and refunds will apply to such services and will be provided prior to subscription.

10. Disclaimers & Limitation of Liability

Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be excluded or limited by applicable law. For users located in the EU or UK, nothing in these Terms affects your statutory rights as a consumer under applicable mandatory consumer protection law.

Aggregate Liability Cap: To the maximum extent permitted by applicable law, our aggregate liability to you for all claims arising out of or relating to these Terms or your use of the platform shall not exceed the greater of (a) the amount you paid us in the twelve months preceding the claim, or (b) USD $100.

You agree to defend, indemnify, and hold harmless Virus Watcher and its officers, directors, employees, and agents from any claims, damages, liabilities, costs, or expenses arising from your use of the platform or violation of these terms.

12. Changes to Terms

We may update these terms from time to time. We will notify you of material changes through the app or by email. We will provide at least 30 days' notice before material changes take effect, except where a shorter period is required by law or to address an urgent security or legal matter. Continued use of the platform after the effective date of changes constitutes your acceptance of the revised terms. If you do not agree to revised terms, you must discontinue use of the platform.

13. Termination

We reserve the right to suspend or terminate your access to the platform at any time for violation of these terms or for any other reason at our discretion. Where permitted by applicable law, we will provide reasonable notice of termination except where immediate termination is necessary to prevent harm, comply with legal obligations, or address a material breach of these Terms.

14. Governing Law & Dispute Resolution

Governing Law. These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions.

EU/UK Consumer Rights: For users located in the European Union or United Kingdom, nothing in this governing law clause shall deprive you of the mandatory consumer protections afforded under the laws of your country of habitual residence.

Dispute Resolution. Any dispute arising under or in connection with these Terms that cannot be resolved by informal negotiation within 30 days shall be submitted to binding arbitration administered by the American Arbitration Association (AAA) under its then-current rules. Notwithstanding the foregoing, either party may seek injunctive or equitable relief in any court of competent jurisdiction. Nothing in this clause prevents EU or UK consumers from bringing claims before the courts of their country of habitual residence.

Class Action Waiver. To the maximum extent permitted by applicable law, you agree to bring claims only in your individual capacity and not as a plaintiff or class member in any class, consolidated, or representative proceeding. This waiver does not apply to users in jurisdictions where such waivers are prohibited.

Virus Watcher is committed to making its platform accessible to users with disabilities. We aim to comply with the Web Content Accessibility Guidelines (WCAG) 2.1 Level AA, the Americans with Disabilities Act (ADA) (US), and EU standard EN 301 549.
